1. Who we are

Cavatus Audio is a trade name of Renke Hohl, a sole proprietor based in Germany (“we”, “us”). These terms apply to this website and to every Cavatus Audio software product (“the Software”), including free demo versions.

2. Purchases through Paddle

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the merchant of record for all our orders: your purchase contract is with Paddle, under Paddle's Buyer Terms. Paddle handles payment, taxes, invoices and returns. The use of the Software itself is governed by the license terms below, which form the supplier agreement referred to in Paddle's Buyer Terms.

Prices are shown including any applicable taxes, which Paddle calculates for your location at checkout. After your payment, you receive your license key and a link to your account by email. In your account you can download the Software and your license file at any time.

Refunds are described in our Refund Policy.

3. License grant

When you buy a license, we grant you a non-exclusive, non-transferable, perpetual license to install and use the Software in the purchased edition, subject to these terms. In particular:

  • A license is personal. It belongs to one person, who may install and use the Software on all computers that they personally use.
  • You may use the Software for private and commercial work. Audio you create or process with it belongs to you without restriction.
  • The license covers all updates we publish for the product, which you can download from your account.
  • License keys and license files are personalized with your name and email address. Keep them for yourself.

4. Restrictions

Unless the law expressly permits it, you may not

  • share, publish, sell, rent or lend your license key, license file or the Software,
  • use one license for several people, for example for all members of a studio or team,
  • modify, decompile, disassemble or reverse engineer the Software, or circumvent its license check,
  • remove copyright, trademark or license notices from the Software.

5. Demo versions

Demo versions are free for evaluation. They are fully functional but insert short periods of silence at regular intervals and do not save their settings. A demo version may not be used to circumvent these limits.

6. Ownership and third-party components

The Software is licensed, not sold. All rights to the Software remain with us. The Software contains components of third parties under their own licenses; the required notices are included with the installer and listed under Third-Party Notices. VST is a registered trademark of Steinberg Media Technologies GmbH.

7. End of the license

The license ends automatically if you materially breach these terms, or if your purchase is refunded or charged back. In that case, you must stop using the Software and delete all copies and license files.

8. Warranty

We work hard to make the Software reliable, but no software is free of errors. Please make sure it works for you with the free demo before you buy, and keep backups of your projects. Your statutory rights regarding defects of digital products remain unaffected.

9. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. For slight negligence, we are liable only for breaches of essential contractual obligations, meaning obligations whose fulfilment makes the proper use of the Software possible in the first place and on which you may regularly rely, and only up to the damage that was foreseeable and typical for this kind of contract. Otherwise, our liability is excluded.

10. Use of this website

The content of this website is protected by copyright. Audio examples and images may not be reused without our permission. We take care to keep the information on this site correct, but we cannot guarantee that it is complete and up to date.

11. Governing law

These terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the law of the country where you have your habitual residence.

12. Changes and contact

We may update these terms for future purchases and versions. The terms that applied when you bought a license continue to apply to that license. Questions? Write to us at support@cavatus.dev.
